How Insurance Claims Work
After an accident, the process of starting an insurance claim begins with you. From the time you let the insurance company know that you have been injured in a car accident, it is very important to secure legal representation. This is where we come in. We contact the insurance company and advocate on your behalf for all of the benefits that you are entitled to. These benefits range from Housekeeping and Maintenance, Attendant Care, Caregiving, Non-Earners and Income Replacement. We send out applications for monthly benefits which you will receive within three to four months after the time we begin your file if you are approved. The next step is mediation, where our firm and your insurance company will negotiate a lump sum amount that you are entitled to based upon several variables; the level of injuries sustained and loss of income. In some cases, your file may be negotiated and settled even before the mediation process.

Mediation Information
Mediation is a process utilized by the insurance company so that they can determine a lump sum settlement amount in order to close an accident benefit claim. In this process, there will be a mediator from FSCO (Financial Services Commission of Ontario), a representative from the insurance company, an associate from our firm, and the claimant. During this session, we will try to negotioate the highest possible settlement amount for our client. Around 95% of the time our clients are satisfied with the amounts that we negotiate for them and accept the offer at this stage. If we feel the offer is lacking, we will proceed into the final stage of which is called arbitration.
